1) Under no circumstances will this cat be declawed.
2) The buyer accepts full responsibility for this kitten/cat and provides properly for its health and well being. The buyer agrees that this kitten/cat will always receive prompt medical care, and that the seller is not responsible for any veterinarian expenses incurred by the purchaser of this kitten/cat.
3) Adequate indoor sanitary facilities will be provided for this kitten/cat. This kitten/cat will never be allowed to roam outdoors without the owner.
4) If this kitten/cat is found to be neglected or in ill health for an unreasonable length of time, purchaser will surrender said cat to seller unconditionally.
5) This kitten/cat is purchased as: Show_____Breeder______Pet______.
6) If kitten/cat is purchased as a pet, purchaser agrees to neuter/spay this cat between the ages of 4 and 9 months, or within 30 days after the purchase if this is an adult cat; purchaser agrees and guarantees that this kitten/cat will not be used for stud or breeding at any time. Seller agrees to provide registration papers on this kitten/cat upon presentation of a certificate of neutering or spaying.
7) The buyer agrees that this kitten/cat or its offspring will never be sold, leased, or given away to any pet shop, kitten mill, or research facility. Additionally, whole male and female kittens may not be sold back into seller’s Region, currently defined as Region 3 by CFA without the written consent of Posh Persian.
8) Should breeding problems arise, it will be up to seller’s discretion as to whether or not the kitten will be replaced, and medical documentation will be required.
9) Seller offers no guarantees on future show achievements on this kitten/cat.
10) If, above said kitten/cat is being sold as a whole/unaltered cat with breeding rights, it is understood that interest or ownership of said cat cannot be transferred, leased, sold or given away to another individual.
11) Purchaser agrees that absolutely no cats other than cats owned and housed in the cattery of Purchaser will be bred by said cat. Said cat must be used in a closed cattery environment only, and absolutely no stud service is allowed without the written consent of Posh Persian. No exceptions.
12) If buyer no longer wishes to keep said kitten/cat, then buyer must offer seller first refusal to have the kitten/cat back at no cost, except for shipping costs, which will be the responsibility of the seller, Posh Persians. If seller declines, then buyer agrees to have kitten/cat altered immediately. Said kitten/cat is expected to be placed in a suitable loving pet home if buyer chooses not to keep the kitten/cat for the remainder of its lifetime.
13) Health Guarantee: Purchaser is receiving a healthy kitten/cat, free of internal and external parasites and all infectious disease or life-threatening congenital defects. Further, said kitten/cat has been vaccinated against panleukopenia rhinotracheitis and calici virus. Purchaser must have his/her own veterinarian inspect said cat within three (3) working days of purchase and if any sign of illness is found, purchaser must contact breeder immediately, and may at his option, either: (1) return said cat to breeder for an equal replacement kitten/cat if available or (2) take kitten/cat to breeders choice of veterinarian for a second opinion, in which case breeder will pay all reasonable costs. If a veterinarian other than the breeder’s choice institutes any treatment or administers any further vaccinations, this guarantee is null and void.
14) Shipping costs are the responsibility of the buyer. If the kitten/cat is returned, the next available kitten of equal will be offered to buyer as replacement. No cash refunds will be given. Prior to any replacement kitten/cat being made, all papers issued with this kitten/cat must be returned, properly signed, transferring ownership back to the breeder. Please, note if the kitten/cat has been exposed to other cats not raised and bred by Posh Persian, no replacement will be given. It is recommended to isolate all incoming kittens and purchaser agrees to isolate this kitten/cat for at least one month before introduction to its other cats.
15) The buyer agrees to pay all court costs if this contract is litigated, and that any Suit that arises out of the purchase of said cat shall be tried and executed in and Under Colorado State law (Colorado State, USA Araphoe County). The sale of this kitten/cat is taking place in the State of Colorado, County of Araphoe, USA. There will be an additional $1000.00 damage fee if this binding Contract is breeched, disregarded or broken and will be paid to the breeder by the Purchaser.
